In this Privacy Policy (“Policy”), we describe how Highscore, Inc. (”Highscore” “we,” “us,” and/or “our”) collects, uses, and discloses information that we obtain about visitors to our website highscore.com (the “Site”), users of our Application (the “Application”), and the services available through our Site and Applications (collectively, the “Services”).

By visiting the Site, using or downloading the Application, or using any of our Services (in a manner explicitly mentioned here, or through any alternative method), you agree that your personal information will be handled as described in this Policy. Your use of our Site, Application, or Services, and any dispute over privacy, is subject to this Policy and our Terms of Use, including its applicable limitations on damages and the resolution of disputes. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Service.

THE INFORMATION WE COLLECT


We may collect information from or about you directly from you, from other data sources, and automatically through your use of our Site, Application, or Services, as described below.

If you decline to provide any requested information, you may not be able to use our Services if that information is necessary to provide you with our Services or if we are legally required to collect it.

A. Information You Provide to Us


Registration and Profile Information. If you join our waitlist, sign up for an account, register to use our Services, sign up to get notifications or updates, claim referral rewards, or participate in our surveys, we may ask you for your name, email address, and other related information.

Communications. If you contact us directly, we may receive additional information about you. For example, if you contact us for support, subscribe to our newsletter, or subscribe to receive email updates about our Services, then we may receive your name, email address, the contents of a message or attachments, and other information you choose to provide.

Payment Information. When you add a credit card or payment method to your account a third-party service provider that handles payments on our behalf will receive and process your payment card information.

Careers. If you apply for a job with us, you may submit your contact information and your resume online. We will collect the information you choose to provide on your resume, such as your education and employment experience.

B. Information We Collect When You Use Our Services


Device Information. We receive information about the device and software you use to access our Application, Site, or Services, including internet protocol (IP) address, user agent, device type and identifiers, and operating system version.

Location Information. We may be able to infer information about your general location (for example, your IP address may indicate your general geographic region).

Usage Information. To help us understand and analyze how you use our Services and help us improve them, we automatically receive general information about your interactions with our Services, such as the date and time of your visits, how often you use our Services, the pages or other content you visit on our Site, and diagnostic information like CPU usage.

Information from Cookies and Similar Technologies. When you visit our Site, we may collect information using cookies, pixel tags, or similar technologies. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services.

If you'd like to modify your cookie settings, please review your web browser's “Help” file. Please note that if you delete or choose not to accept cookies from the Service, you may not be able to utilize the features of the Service to their fullest potential.

HOW WE USE THE INFORMATION WE COLLECT


We use the information we collect:

  2. To inform future feature and product development efforts;
  3. To provide, maintain, improve, and enhance our Services;
  4. To communicate and provide you with updates and other information relating to our Services, provide information that you request, respond to communication and provide support;
  5. For marketing purposes, such as creating promotional marketing materials that may be relevant, valuable or otherwise of interest to our users;
  6. To facilitate transactions and payments;
  7. To aggregate information collected through the Services and use it for any lawful purpose;
  8. To detect and prevent fraud, and respond to trust and safety issues that may arise;
  9. For compliance purposes, including enforcing our Terms of Service or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and

HOW WE SHARE THE INFORMATION WE COLLECT


We do not disclose information from or about you or your devices without your permission, except in the limited circumstances described below:

Third Party Service Providers. We may share any information we receive with certain third party vendors, partners and service providers retained in connection with the provision of our Services, such as contractors, agents, or sponsors, who help us manage, or provide the Services. These service providers assist us in providing, and managing the Services. Examples of such services include, without limitation: marketing, developing or supporting products and features, and processing payments.

Analytics Partners. We use automated devices and applications, such as Google Analytics and Hotjar, to evaluate usage of our Site, and to the extent permitted, our Application. We also may use other analytic means to evaluate our Site and Application. These services may also collect information about your use of other websites, apps, and online resources. As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal processes, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others' rights, property, or safety. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through the Services.

Merger, Sale, or Other Asset Transfers. We may disclose and transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our business or assets.

YOUR CHOICES


App Information. You can opt-in or opt-out of our collection of specific usage information at any time through the settings menu or via configuration in the onboarding sequence.

Marketing Information. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt-out of receiving promotional messages from us, by default, we will continue to send administrative messages that include important product updates. You can opt out of receiving administrative messages by contacting us directly at contact@highscore.com.

How to Block Cookies. You can change your browser settings to block, disable, or notify you when you receive a Cookie, delete Cookies, or browse our Site using your browser's anonymous usage setting.

If you choose not to provide us with the requested or requisite information, some features of our Services may not work as intended.

THIRD PARTIES


Our Services may contain links or allow access to other websites and services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities or information disclosure with regard to these third parties. We encourage you to read their privacy policies before providing any information to them.

INFORMATION RETENTION


We will only store your information for as long as it is necessary to provide our Services as set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements) or you request data deletion.

SECURITY


We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. However, as our Services are hosted electronically, we can make no guarantees as to the security or privacy of your information.

CHILDREN'S PRIVACY


We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Services are directed to children. By agreeing to our Privacy Policy and Terms of Service, you represent that you are allowed to use our Services according to your country's applicable age limits. If we learn that a child is under the age of 13 in the United States, or is under the applicable age requirement in another jurisdiction, we will take reasonable steps to obtain parental consent or delete the user's personal information from our files as soon as is practicable. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at contact@highscore.com.

ADDITIONAL DISCLOSURES FOR CALIFORNIA RESIDENTS


The California Consumer Privacy Act (CCPA) provides additional privacy protections for California consumers, including: a) The Right to Know – the right to see what personal information we have about you, your computer or device, b) The Right to Delete – the right to delete the information we have about you, your computer or device and c) The Right to Non-Discrimination – we will not discriminate against you if you exercise any of the above rights.

Other privacy rights under the CCPA:

  1. You may object to the processing of your personal data.
  2. You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data.
  3. You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
  4. You may request to opt-out from future selling of your personal information to third parties. We do not “sell” personal information as defined by the CCPA.

The CCPA defines personal information broadly and as such, it includes pseudonymous identifiers such as cookie IDs and mobile advertising IDs. Under the CCPA, your request to see the personal information that we have about you may include: (1) specific pieces of personal information that we may have about you; (2) categories of personal information we have collected about you; (3) categories of sources from which the personal information is collected; (4) categories of personal information that we sold or disclosed for a business purpose about you; (5) categories of third parties to whom the personal information was sold or disclosed for a business purpose under the CCPA; and (6) the business or commercial purpose for collecting or selling personal information.

Please note that to protect your information and the integrity of our Services, we may need to verify your identity before processing your request. In some cases, we may need to collect additional information to verify your identity, such as a government issued ID. We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification.

INTERNATIONAL VISITORS


Our Services are hosted in the United States and intended for visitors located within the United States. If you choose to use the Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and operating the Services. By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.

If you choose to use the Services from certain regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request and obtain a copy of your personal information (we may charge you a small fee for this service), (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

UPDATE YOUR INFORMATION

CHANGES TO THIS PRIVACY POLICY


We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through the Services, we will attempt to notify you through the Services, by email, or other means.
